Nookhub Inc. ("we", "our" or "us") respects your concerns about privacy. This Privacy Notice applies to (i)www.nookhub.com and the Nookhub iOS “Mobile Application” (collectively, the “Sites”), and (ii) your use of or other interaction with our bicycle parking program (the “Service”). This Privacy Notice describes the types of personal information we collect about consumers, how we use the information, with whom we share it and the choices available to you regarding our use of the information. We also describe the measures we take to protect the security of the information and how you can contact us about our privacy practices.
We may request, collect and/or display some of your Personal Information when using the Services. It helps us make the Sites better, send you information, improve content, operate the Services, offer promotions, and customize ads.
The types of Personal Information we may collect includes:
Contact information (such as name, postal address, email address and telephone number or other unique device identifier assigned to your mobile device);
date of birth;
payment information (such as your payment card number, expiration date, authorization number or security code, delivery address and billing address);
your geographic location, in connection with your use of the Sites or the Service;
photographs, comments and other content you provide;
Personal Information also includes your log-in credentials, password, transactional information based upon your activity on the Sites (information we need to get paid and to pay you), user feedback and comments, demographic information, and authentication information. Some of this information is mandatory and some is optional. For example, all of our Services are location-based services and thus we collect and store information about your location when you use our Service, and when you make a Nook Reservation. This information can come from a variety of sources depending on how you access the Services; for example, a mobile phone may report its GPS location at the time you access our Sites or Services. We need to be able to locate you in real- time so that we can make recommendations to you for the nearest Nook. We track locations in real-time and have this data visible on our Sites through the use of Google Maps.
We may also receive other information directly from Third Party Services, such as your name, profile photo or avatar, job title. [If you give us permission through the account settings, we may also access your Facebook Friends and other similar information from Third Party Services.] You acknowledge that this information is your Personal Information and by creating an Account on the Services and providing Personal Information to us, you allow others, including us, to identify you. When you use the Service, we may know your location and you are granting us permission to contact you, as appropriate, for use of the Services.
In addition, when you visit our Sites, we may collect certain information by automated means, such as cookies, web beacons and web server logs. The information we collect in this manner may include IP address, unique device identifier, browser characteristics, device characteristics, operating system, language preferences, referring URLs, information on actions taken on our Sites, and dates and times of visits to the Sites. A “cookie” is a file that websites send to a visitor’s computer or other Internet-connected device to uniquely identify the visitor’s browser or to store information or settings in the browser. A “web beacon” also known as an Internet tag, pixel tag or clear GIF, links web pages to web servers and their cookies and may be used to transmit information collected through cookies back to a web server. Through these automated collection methods, we obtain “clickstream data,” which is a log of the links and other content on which a visitor clicks while browsing the Sites. As the visitor clicks through the Sites, a record of the action may be collected and stored. We may link certain data elements we have collected through automated means, such as your browser information, with other information we have obtained about you to let us know, for example, whether you have opened an email we sent to you. Your browser may tell you how to be notified when you receive certain types of cookies or how to restrict or disable certain types of cookies. Please note, however, that without cookies you may not be able to use all of the features of our Sites. When you use the Sites, neither we nor any third parties collect personal information about your online activities, over time and across third-party websites. Our Sites are not designed to respond to “do not track” signals from browsers.
We may use third-party analytics services on the Sites, such as those of Google Analytics. The information obtained for this purpose (including your IP address and other information collected by automated means) will be disclosed to or collected directly by these service providers. We collect statistical Information about how both unregistered and Account users, collectively, use the Services(“Aggregate Information”). Some of this Information is derived from Personal Information. However, statistical Information is not Personal Information and can’t be tied back to your Account. Certain non-Personal Information could become Personal Information is aggregated with other pieces of data in a way that enables you to be identifiable. We may at times combine non-personal information with Personal Information to better deliver the Services and special offers and ads to you and also to better understand how our App and the Services are used. In the event that such data is combined, it will not be shared with third parties. The providers of third-party apps, tools, widgets and plug-ins on our Sites, such as social media sharing tools, also may use automated means to collect information regarding your interactions with these features. This information is collected directly by the providers of the features and is subject to the privacy policies or notices of these providers. To the extent permitted by applicable law, we are not responsible for these providers’information practices.
We may use the information described above to:
Provide products and services to you, such as to allow you to park a bicycle
Create and manage your account;
Process your payments;
Send you promotional materials and other communications;
Communicate with you about, and administer your participation in, special events, contests, sweepstakes, programs, offers, surveys and market research;
Respond to your inquiries;
Operate, evaluate and improve our business (including developing new products and services; monitoring, enhancing and improving our systems and services; managing our communications; analyzing our products and customer base; performing data analytics; and performing accounting, auditing and other internal functions);
Verify your identity;
In addition, we use information collected through cookies, web beacons, pixels, web server logs and other automated means for purposes such as (i) customizing our users’ visits to our Sites, (ii) delivering content tailored to our users’ interests and the manner in which our users browse our Sites, and (iii) managing our Sites and other aspects of our business. Generally, the usage information is collected and used in the aggregate so that we can make the Services better. We treat this information as non-Personal Information, except where required to do so by applicable law. We may associate your unique mobile device identifier or Site usage information with any Personal Information you provide, but we will treat the combined information as Personal Information.
We also provide some of your Personal Information (such as your first name and your photo) to the Cyclist/Nook Holder so that you may contact each other. We also may use the information in other ways for which we will provide specific notice at the time of collection.
We do not disclose personal information we collect about you, except as described in this Privacy Notice. We may share your personal information with service providers who perform services on our behalf. We do not authorize these service providers to use or disclose the information except as necessary to perform services on our behalf or comply with legal requirements. In addition, we may share your information with (i) our subsidiaries and affiliates, and (ii) joint marketing partners or other co-branded third parties.
We also may share information with other public and private organizations for statistical and research purposes.We reserve the right to transfer personal information we have about you in the event we sell or transfer all or a portion of our business or assets (including in the event of a reorganization, dissolution or liquidation). In addition, we may disclose information about you (i) if we are required to do so by law or legal process, (ii) to law enforcement authorities or other government officials, (iii) to enforce or exercise our rights under our agreements with users or to investigate or defend against any action or allegation against us, or (iv) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss, or in connection with an investigation of suspected or actual fraudulent or illegal activity.
We tell you how we are using the data when you submit it to us, i.e. use of Site features, response to advertisers, information requests, products or services purchases, survey responses, or other purposes. Some of your activity is public by default, i.e. content you publicly post and some profile information. Account holders have this data associated with them. Unregistered users have anonymous information tracked (such as what pages they have visited on our Web)
You will be notified if your Personal Information may be shared with third parties other than as already described herein, and you will be able to prevent the sharing of this Information.
In order for us to communicate with you in real-time and most quickly enable a Nook transaction, we need to email and text message you directly. Please be advised that your mobile phone carrier’s text message rates will apply. By using the Service you are giving us permission to send you text messages and emails regarding the transactions you request. We track when you open emails so that we can deliver more interesting emails for you. If you cannot be reached this way, then it will be challenging for you to use the Services. Other than for transactional and Account-related matters, if you don’t want to hear from us, please unsubscribe. We will not send you text messages for anything unrelated to the Service you request.
We maintain administrative, technical and physical safeguards designed to protect the personal information you provide against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use. Please don’t give out your password, and please sign out of public computers when accessing your Account. We try our best to protect your security, but we can’t guarantee it (hacking happens). Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time.
Safeguarding your information is important to us and we appreciate your cooperation in doing the same. Identity theft and “phishing” are rampant and problematic. We will never email you to ask for your password, payment information, credit card, bank account, PayPal account.
If you share Personal Information using certain public features of the Sites, or information with us through the use of your Facebook, Twitter or other Third Party Service (including locational data), other people who see it may share that information without your control or knowledge and people might know where you are parked. Be smart about sharing Personal Information through publicly accessible websites and services.
The Sites and the Service are not directed to individuals under 18 years old. We do not knowingly collect Personal Information from individuals under 18.
We take legal inquiries seriously and we will cooperate with local, state, federal and international governmental authorities to enforce and comply with the law. At our sole discretion, we will disclose any information necessary to comply with the law, respond to claims, and participate in the legal process (including subpoenas) to stop or prevent illegal, unethical or objectionable activity, protect public safety, or protect the property and rights of the Company.
This Privacy Notice may be updated periodically and without prior notice to you to reflect changes in our personal information practices. For significant changes, we will notify you by posting a prominent notice on the Sites indicating at the top of the Notice when it was most recently updated.
